1. General Information and Acceptance

These Terms of Service (the "Terms") govern the access to and use of the website droneofficial.net and all services provided by DRONES FOR GOOD SL ("DroneOfficial", "we" or "us").

2. Definitions

• "Client" means any organisation or individual that engages DroneOfficial to request drone services.
• "Pilot" or "Drone Operator" means any certified drone pilot contracted through DroneOfficial to deliver drone services.
• "Services" means all drone-based services offered through DroneOfficial, including but not limited to aerial photography, videography, mapping, surveying, inspection, monitoring and data collection.
• "Drone Data" means any information, data or content collected through drones, including aerial images, videos, sensor readings, geospatial data, telemetry and associated metadata.
• "Platform" means the digital infrastructure, software and services provided by DroneOfficial at droneofficial.net.

3. The Service

DroneOfficial operates as a professional drone services agency, connecting clients with certified drone pilots to deliver aerial data collection, inspection, mapping, photography and related services across multiple industries including agriculture, construction, energy, real estate and more.

All drone operations are performed by certified pilots in compliance with applicable aviation regulations, including EASA (European Union Aviation Safety Agency) rules and Spanish national aviation authority (AESA) requirements.

4. Conditions of Use

The Service is not directed to, and may not be used by, persons under the age of 18. By using the Service, you agree and warrant that you will not:

• (a) Use the Platform or Services to transfer or upload content containing viruses, malicious software or harmful programs.
• (b) Use the Platform or Services to defame, harass, discriminate or threaten any person, or violate the rights of others.
• (c) Distribute, reproduce, alter, decompile or reverse engineer any part of the Platform or Services, unless expressly permitted by mandatory law.
• (d) Use automated software to extract data from the Platform without our written consent.
• (e) Use the Platform or Services for any unlawful, unauthorised or military purpose.
• (f) Use the Platform or Services in any manner that violates or infringes the rights of any third party.

5. Intellectual Property

All content on the Website, including texts, photographs, graphics, images, icons, software, graphic design and source code, constitutes intellectual property owned by Drones For Good SL or its licensors. No exploitation rights are transferred to the user beyond what is strictly necessary for proper use of the Services.

DroneOfficial retains the right to use anonymised or aggregated data for service improvement, portfolio showcasing and marketing purposes, unless the Client expressly objects in writing.

You agree to respect all intellectual property rights, including copyright, trademarks, patents and trade names, whether registered or not, contained or displayed on the Platform.

6. Quotes, Orders and Payments

All quotes provided by DroneOfficial are subject to pilot availability, site accessibility, weather conditions and necessary flight authorisations. Quotes are valid for 30 days unless otherwise stated. Prices are expressed in euros (EUR) and are exclusive of applicable taxes (IVA) unless otherwise indicated.

Payment terms: Unless otherwise agreed in writing, payment shall be made as follows: 50% advance payment upon order confirmation, 50% balance upon delivery of the Drone Data. All invoices are payable within 30 days of issuance.

External factors such as adverse weather conditions, delayed flight permits, local regulatory changes, pilot availability or other unforeseen circumstances may delay delivery dates or require quote adjustments. DroneOfficial will inform you of any changes before proceeding.

7. Delivery and Acceptance

Upon delivery of Drone Data, the Client shall have a period of ten (10) business days to review and confirm the quality and completeness of the delivered data. Failure to provide feedback within this period shall constitute acceptance of the deliverables.

8. Disclaimer of Warranty

The Platform and Services are provided "as is" without warranty of any kind. While DroneOfficial strives to deliver high-quality services, we do not guarantee uninterrupted access to the Website, nor that results will meet specific expectations beyond what is agreed in writing. There may be situations when the Services will not be accessible, including necessary maintenance and circumstances outside our control.

9. Limitation of Liability

To the extent permitted under mandatory law, DroneOfficial shall not be liable for any indirect, incidental, consequential or special damages, including loss of profit, loss of revenue, business interruption or loss of data arising from the use or inability to use the Services.

DroneOfficial is not liable for any action by a Drone Operator during the performance of the Service beyond the scope of the agreed mission. Drone Operators are independent contractors solely responsible for their flights and compliance with applicable aviation regulations.

10. Force Majeure

Neither party shall be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to: natural disasters, war, terrorism, government actions, epidemics, strikes, power failures, adverse weather conditions, airspace restrictions or equipment failures ("Force Majeure Events"). The affected party shall notify the other party promptly and use reasonable efforts to mitigate the impact.

11. Data Protection

DroneOfficial processes personal data in accordance with our Privacy Policy, available at droneofficial.net. By using our Services, you acknowledge and accept the processing of your personal data as described therein.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be published on the Website and, where material, we will provide at least thirty (30) days' notice before changes take effect. Continued use of the Services after such notice constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain and applicable European Union regulations.

Any disputes arising from or in connection with these Terms shall be submitted to the courts of Barcelona, Spain, without prejudice to any mandatory consumer protection provisions that may apply.

14. Severability

If any provision of these Terms is declared null or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect.
